Terms And Conditions

These terms and conditions apply to the contract between us for the supply of goods ordered by you but do not affect any statutory rights you my have.

Unless otherwise agreed all sales made by Nisbets are made on these conditions of sale. No variation of these conditions of sale or any terms supplied with any order form or other document provided by you will be binding on Nisbets unless confirmed in writing by a Director of Nisbets. All goods are subject to availability. As a result of continuing product development the specification or design of goods may vary from that shown. You are responsible for deciding on the suitability of goods offered for any particular purpose and for the consequences arising for any work we undertake on the goods at your request.

1. Prices And Payment

All prices and product specifications published are given in good faith; however Nisbets reserves the right to change the price of a product, or product specifications at any time.
Where Nisbets has agreed to issue an invoice, this must be paid within 30 days of the invoice date.
For as long as payment is outstanding goods will remain the property of Nisbets. Nisbets may charge 8 percent interest on any outstanding amount on a credit account that has not been paid by the due date.
Nisbets price match promise excludes comparing like for like products from companies within the Nisbets Plc group.
Nisbets may at it's discretion refuse orders or to offer credit terms. All Customers will be subject to validation checks; this covers the use of all methods of payment. For Credit and Charge Card Holders validation will be sought from Card Issuer. In addition, in the interest of preventing fraudulent use of Credit, Debit and charge cards, the Company will validate the names, addresses and other information supplied during the order process against commercially available records (e.g Electoral Roll data, Credit Reference Services). A third party may also be instructed to complete these checks. Credit Account Customers may be scrutinized by all or some of these methods. By ordering from the Company you consent to such checks being made. The Company may need to contact you by letter, telephone or e-mail to verify details before we are able to process and dispatch your order or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information.

2. Delivery

All products are subject to availability.
If ordered before 4pm, stocked products are usually delivered within 24 hour delivery on the Irish mainland (excludes some remote areas and weekends). Large or fragile items may take longer. Delivery times are stated as a guideline and are subject to change.
For offshore or remote areas a supplementary delivery cost may apply. Machine, refrigeration and all flat pack items prices include delivery to the ground floor entrance of the building. Delivery does not include negotiating lifts or stairs. Customers are responsibe for ensuring that products ordered will fit through doorways and into their premises. The price does not include unpacking or positioning or assembling items.
Due to the high cost of carriage and handling, a restocking fee may be incurred if it is necessary to return large items. Risk or damage to goods passes to the customer upon delivery. Claims for non-delivery or damages must be notified to Nisbets within 7 days of delivery. Customers must contact Nisbets for authorisation when returning goods. Any goods returned without authorisation will be rejected and returned at the customers cost. products that have been specially ordered, embroidered or engraved will only be accepted for return if defective.

3. Guarantee And Liability

Goods supplied by Nisbets are guaranteed in accordance with the terms of the manufacturer's warranty provided with the goods or for 1 year if not stated with the goods. The warranty applies to UK mainland only. if any Nisbets product proves defective within 1 year of purchase we will repair it at no cost to you. Our warranty does not apply to wear and tear, or if a product hs been damaged or misused. It does not apply to a small number of machines marked 'no commercial warranty' which are suitable for domestic use only and which must be returned to the manufacturer in the event of a breakdown. machines returned for repair in warranty where it is found that the machines has been abused or has not been used as the machine was designed for will be charged for. This also applies where a machine has not been properly maintained including cleaning and descaling where applicable. Machines retured for repair are not reassembled if upon quotation you do not require the machine to be repaired. Loan machines are not available. Nisbets accepts no liability of whatever nature arising from as a result of any representations, breach of contracts, late delivery of product, negligence or otherwise including but not limited to any liability for indirect or consequential loss, or loss of profits, revenue, business or goodwill except for liability of death or personal injury caused by Nisbets negligence. All conditions, warranties, guarantees and representations, express or implied, by statute, common law or otherwise in relation to the goods (other than the liability which Nisbets is not permitted by law to exclude or restrict) are hereby excluded.

4. Status

Nisbets may at its absolute discretion decline to accept orders or to offer credit terms. Placing an order with Nisbets is taken as authorising us to approach a credit agency on the details given. All errors and omissions excepted. All trademarks acknowledged.

Accuracy of information

Nisbets ("the Company") use their best endeavours to ensure that the information contained in their website is accurate and not misleading. Accordingly the Company retains the right, without obligation, to amend or delete product information without notice.

Our liability

In so far as it is possible by applicable law the Company expressly excludes liability for any claims, loss, demands or damages of any kind whatsoever, with respect to use of this website or any misleading information or omissions it may contain, including without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of revenue, loss of data, loss of profits or otherwise. If you are a consumer your Statutory Rights, if any, are not affected. Nothing in this clause is intended to exclude liability for death or personal injury arising from the negligence of the Company or its employees or agents.

Passwords

On registration you will be required to submit a password which you will need to access your account. You will be responsible for the security of this password and the Company advises that you do not disclose it to third parties and that you change it on a regular basis. The Company will not be liable for any loss resulting from the misuse of your password.

Customer use

The information provided on this website is intended to be used only by the customer. The Company does not authorise the use of such information for any purpose other than your use as immediate consumer, and prohibits to the maximum extent allowable the resale, redistribution, and use of this information for commercial purposes.
